COMMUNAL VIOLENCE BILL

People these days are talking about communal harmony bill. But what is this?? How will it affect the population of India?? What are the key factors of this bill?? Search the world wide web and you will rarely find anything like this.

What you will find is news about Communal Violence Bill, Rumors about the bill, and you will also get a complete document of about 30 or 40 pages from government of India describing the bill which is hardly understandable just because of the terms used in the document. Those terms which can be easily understood by Advocates, Juries and all. Means they are all Law terms.

I am writing this blog to bring this bill to your knowledge after spending hours in readings and hearings from people.

So here is the information.

This bill is defined in terms of Minorities and Majorities, where, minority refers to people in minority as per their language i.e. linguistic minority, people in minority as per their religion i.e. religious minorities and people from Scheduled Castes and Scheduled Tribes are also covered under minorities. Rest all other citizens of India are understood as majority.Main points of the bill are:-

• This bill suppose that every-time, majority attacks minority and only minorities are affected by Communal Violence. So, as per the bill, a person from minority can file a complaint against person from majority anytime and charge him for communal violence.
• A person from Majority can't interfere in dealing of minorities i.e. if a person from minority approaches you to purchase your land and you reject the offer than, he may approach court and charge you that you are interfering in his/her business.
• Suppose you utter some words that affect the mental status of a minority than, he/she is eligible to approach court and would charge you of disturbing his mental state and hatred.
• People from Minority Community can not express verbal anger or protest for any anti-social activity of a person from minority and if some one does so, then he will be charged accordingly. It means, Hindu can not ask the government to hang Kasab (it's just an example, Kasab is already hanged to death) because Hindu is covered under majority while Kasab is covered under Minority.
• As per the Constitution of India, a person is not liable to be called Guilty until  or unless he is proved Guilty, but, as per this bill, a person charged by a minority is liable to be called Guilty until or unless he proves that he is not Guilty. This is seriously not fine.
• If Communal Violence hits any state or any Union Territory of India, then, Center holds its rights to send Paramilitary forces to respective state. It means center is always free to interfere in matter of States and center will get this right which is against the constitution of India. Constitution of India said that center cannot interfere in matter of states until or unless state asks the center for help.
